Fellow Blogger VOX CANTORIS Threatened with Lawsuit by Vatican Official Fr. Thomas Rosica, CSB

We may have come late to announcing this shocking news, already widely reported by Catholic bloggers all over the web, but we stand firmly with Vox Cantoris (David Domet) and in solidarity with him for his valiant fight for Truth, to protect the Church from her enemies in its midst who teach heresy and harm the souls of men. Domet’s crime? None other than revealing the blasphemous and scandalous pronouncements made by Papal Advisor, Fr. Rosica, who is now threatening to sue David Domet for bringing these heretical statements to light!

Today, the first Sunday of Lent, let us take heed of the words of the Introit for Holy Mass: “He shall cry to me, and I will hear him: I will deliver him, and I will glorif him: I will fill him with length of days. Ps. He that dwelleth in the aid of the most High shall abide under the protection of the God of Heaven. Glory be.

    I don’t specialize in the law of libel and slander – and neither does Nina Perfetto, the signatory of the Fogler, Rubinoff letter to Mr Domet – but my admittedly non-specialist eye sees nothing defamatory in the specific statements complained of by Perfetto. They were most certainly hurtful, but to make merely hurtful (even if false) statements is not an actionable tort. If they were, our recently departed friend, Tribunus, would be having his lawyers send me a letter similar to Perfetto’s.

    My advice to Mr Domet is to take this threat seriously, but not to lose sleep over it; and if he can afford it, to arrange an initial consultation with this man. Julian Porter, Q.C., is not a highly regarded criminal lawyer, but he is Ontario’s most distinguished libel law practitioner. One of his quips germane to this case is:

    “Against the argument that you cannot cry fire in a crowded theatre: Oh yes you can – you must, if in your considered view there is a fire. In that case there is a duty to cry fire.”

    On a side note: Fogler, Rubinoff LLP is a highly regarded commercial litigation firm with deep roots in the Toronto Jewish community, which leads me to wonder what the senior partners there think about this deadline imposed on poor Mr Domet by Perfetto, their Italian (Catholic?) colleague:

    “If our demands are not complied with by the end of business on February 22, 2015, we will seek instructions to commence an action against you.”

    David Domet should think about crowdfunding his legal fight against Fr Rosica’s detestable effort to muzzle fair comment by a loyal Catholic defending Holy Mother Church from harm. I, for one, will contribute to such a pool if it’s set up. Fr R is likely to end up with a lot of egg on his face when this is all over.

    No, it’s not just you, GK. But start by simply Googling Vox Cantoris rather than linking it from an intermediary website. It may still be slow, but Mr Domet’s Vox Cantoris blog should open in a few seconds.

    An easier way to get into Vox Cantoris’ blog would be to click into the highlighted name itself in our above article. It takes you straight to the blog. It does, as JH says, take a few seconds to appear though.

    We are now all holding our breath to hear the latest, now that the time limit (“the ultimatum”) in the letter of Fr. Rosica’s solicitors is up.
    No requested ‘apology’ or withdrawal of comments was necessary, for everything that has been repeated by David Domet (Vox Cantoris) is of public domain and proven to truly have been Fr. Rosica’s own pronouncements!

    Because it’s between two Catholics on an ecclesiastical matter, it might have been more appropriate for Fr Rosica to start an action in Canon Law against Mr Domet (I think that it is possible), if Rosica wants to go down the litigious road. Keep the squabbles inside the family. If it is possible, why did Rosica not choose it?

    Various Singapore government figures have several times sued their opponents (civilly) for defamation and this seems to have silenced them quite well, as well as bankrupting most of them. This has earned Singapore a spot in the third category out of four in such things as the Democracy Index, with a low level of press freedom and with suppressed civil liberties. Be positive! That’s one above North Korea and Saudi Arabia! Erm, Fr Rosica?

    No doubt coincidentally, the same party has been in power in Singapore since self-government was achieved in 1959.

    Thank you Barona – that’s a great idea! A Rosary Bouquet for David and his wife, who are clearly suffering a lot of anxiety at present, is a wonderful and powerful way to help them.
    On the other post on your Facebook page you have a link to a very pertinent article from Tom O’Toole that others might also be interested in.

    This unprecedented attack on a Catholic blogger’s liberty to stand up for Catholic teaching and point out the errors of a Vatican spokesman (of all people) who flagrantly undermines it, has left us all flabbergasted. However we should not forget how faithful Nick Donnelly from the “Protect the Pope” blog was also silenced by his Bishop, though no one really knows why! And then of course we had the case of the near destruction of the traditional FFI too.
    Anyone else starting to see a trend here?

  16. If the Vatican Press Office and Secretariate of State get thousands of letters from all over the world stating that they are scandalized by the behavior of Fr. Rosica, which is contrary to the recommendations of Our Lord and St. Paul about Christians not sueing one another in secular courts. One also wonders how much he is paying these lawyers, also scandalous. . If they get a flood of complaints, they cannot simply ignore them and it is likely that Rosica will be sent packig back to Canada and told to quit his sueing.
